The Landlord & Tenant Act 1987 - An Update on Residential Tenants’ Rights

Introduction

Owning a block of flats or a mixed commercial/residential building is made harder by the existence of residential tenants’ pre-emption rights under the ‘ill drafted, complicated and confused’ 1987 Act.

A proposed disposal may first have to be offered to the residential tenants - even before binding terms have been agreed with a 3rd party - and failing to make that offer is a criminal offence for the owner and gives the flat owners rights against the 3rd party.
