Introduction

This virtual classroom seminar will focus on understanding how best to approach negotiations of agreements for lease. It is absolutely key to understand and appreciate how these agreements fit into the bigger development picture, so that their terms can be drafted and agreed to reflect what is happening in the background as well as what has been agreed with your client. With so many different parties involved, how do you balance all of their different objectives and ultimately do the best possible job for your clients?

By the end of this course, you will have gained insight into how to approach negotiations of agreements for lease (whether acting for landlord or tenant), a deeper understanding of all of the issues involved, and the bigger picture will put you in a far stronger position when approaching these types of negotiations.

  • The key parties to development - what is important to each party? What are their competing concerns and objectives and how do these ultimately affect the agreement for lease
  • An explanation of the two main types of building contract, how they work and where collateral warranties fit in. What are collateral warranties and why are they important?
  • A closer examination of the agreement for lease including what you should look for in the key areas
  • What should you expect in relation to the building obligations, overall timings, dealing with variations, measurement of the final build, early access requests, practical completion, and dealing with defects?
